1. Acceptance

By accessing or using KCM, you agree to these terms. If you do not agree, do not use the service.

2. Permitted Use

You agree to use KCM in compliance with applicable laws and not to compromise the security, integrity, or availability of the services.

3. Licenses & Ownership

KCM is licensed on-premise software: you deploy and operate KCM on infrastructure under your own control (your servers, your Kubernetes cluster, your cloud account). ELITE-TECH does not host KCM as a managed service and does not have access to the Kafka data, configurations, or logs you process with KCM.

The software, trademarks, and content associated with KCM are owned by ELITE-TECH or its licensors. The subscription grants you a non-exclusive, non-transferable right to use KCM within the limits defined by your plan (number of clusters, modules, users) for the duration of your subscription. No implied license is granted beyond what is expressly authorized.

Your installed KCM instance periodically contacts api.kcmhub.io to validate the license key and expiration. This validation call does not transmit any data from your Kafka clusters, your users, or your configurations — only the license identifier and version are exchanged. 4. Accounts & Privacy

You are responsible for activities performed via your access. Data processing is described in our Privacy Policy.

5. Limitation of Liability

KCM is provided “as is.” To the extent permitted by law, ELITE-TECH disclaims liability for direct or indirect losses related to the use of the service.

8. Payments & Subscriptions

Card payments and subscriptions for KCM are processed by Stripe Payments Europe, Limited (“Stripe”). Your payment credentials are transmitted directly to Stripe; ELITE-TECH does not store full card numbers or CVC.

Subscriptions renew automatically (monthly unless stated otherwise) until you cancel. You can manage or cancel your subscription at any time via the customer portal link provided after checkout and on your invoice. Cancellation takes effect at the end of the current billing period; we do not provide prorated refunds for partially used periods (consumer statutory rights remain unaffected). We may update pricing with prior notice (at least 30 days for recurring subscriptions). All fees are payable in EUR unless otherwise specified.

Prices are shown exclusive of VAT. Taxes (including VAT) are calculated and collected where required via Stripe Tax. Invoices are issued after each successful charge and remain accessible via a secure link.

9. Trials, Refunds & Right of Withdrawal

If a trial is offered, it will be clearly indicated at checkout. Unless you cancel before the trial ends, the paid plan starts and the first charge is made automatically. Except where required by law, payments are non-refundable once the billing period has started.

Consumers (EU/EEA) — 14-day right of withdrawal. If you subscribe as a consumer (i.e. for purposes outside your trade, business or profession) and you are located in the EU/EEA, you have a statutory right to withdraw from the contract within 14 days from the day after the contract is concluded, without giving any reason (Article L221-18 et seq. of the French Consumer Code, transposing Directive 2011/83/EU).

KCM is supplied as a digital service. By starting to use the service before the end of the 14-day withdrawal period, you expressly request immediate performance and acknowledge that you will lose your right of withdrawal once the service has been fully performed, in accordance with Article L221-28, 13° of the French Consumer Code. You will be asked to confirm this acknowledgment at checkout where applicable.

To exercise the right of withdrawal (where it applies), notify us via the Contact page or at contact@kcmhub.io before the 14-day period expires, including your order reference. We will refund any payment already made within 14 days of receiving your withdrawal notice, using the same payment method, unless you have agreed otherwise.

This right does not apply to subscriptions taken out in the course of a business activity (B2B).

10. Merchant of Record & Legal

The merchant of record is ELITE-TECH, registered in France under SIREN 839 542 917 (RCS Créteil), VAT FR95839542917. These Terms are governed by the laws of France. Any dispute shall be subject to the exclusive jurisdiction of the courts of Paris (France), without prejudice to mandatory consumer protections that may apply in your country of residence.

11. Prices & Taxes

Current subscription prices are published on our Pricing page and may evolve over time. The KCM Starter plan is offered at €10/month or €99/year (excluding VAT). The KCM Pro plan is quoted individually based on modules and clusters. Enterprise pricing is custom. Taxes (including VAT) are calculated and collected where required based on your billing details and location, using Stripe Tax. The final amount shown at checkout includes any applicable taxes. All amounts are charged in EUR unless stated otherwise.

Legacy Pro grandfathering. Customers who subscribed to the previous Pro plan (€10/month with all modules included) before the packaging restructure of May 2026 keep their current features and price for a guaranteed period of 18 months, until November 12, 2027. Before that date, we will contact each affected customer to discuss a transition to the new Pro plan. No retroactive price increase will apply during this grandfathering period.

12. Strong Customer Authentication (SCA)

Your bank may require additional authentication (SCA/3-D Secure) to complete a payment. Any exchange fees or bank charges are your responsibility.

13. Invoicing

An invoice is issued after each successful charge and remains accessible via a secure link (hosted by Stripe). You are responsible for providing accurate billing information (including VAT ID where applicable). Invoices and related accounting records are retained for the legally required period.

14. Data Protection — Roles and Limited DPA

Because KCM is licensed on-premise software (see Section 3), ELITE-TECH does not, in normal operation, process personal data on behalf of the Customer. The Customer deploys KCM on its own infrastructure and remains the sole controller (and, where applicable, processor) of all personal data flowing through Kafka topics, configurations, audit logs, and user accounts managed by its KCM instance. ELITE-TECH has no access to, and does not receive, that data.

14.1 What ELITE-TECH actually receives

14.2 When ELITE-TECH may temporarily act as processor

If, during a support engagement, the Customer chooses to share material containing personal data (e.g., unredacted logs, configuration dumps, screenshots showing end-user identifiers), ELITE-TECH will act as a processor for that limited scope, on the Customer’s documented instructions, and will:

14.3 Standalone DPA on request

Customers whose procurement, security, or compliance processes require a separate, signable Data Processing Agreement — even for the limited support scope described above — may request one at dpa@kcmhub.io. The DPA will reflect the on-premise nature of KCM and will be limited to the support-related processing described in Section 14.2. It will also reference, where relevant, EU Standard Contractual Clauses (Commission Implementing Decision (EU) 2021/914) for any international transfer.

14.4 Sub-processors

Because ELITE-TECH does not host the Customer’s KCM data, there are no operational sub-processors for the Customer’s data. The sub-processors listed in our Privacy Policy, Section 4, are used by ELITE-TECH for its own operations (website, analytics, billing, consent management, support). They do not have access to the Customer’s KCM instance.
